Notice as under Legislative Decree 30 June 2003 “Personal data protection code”

As to art. 13 of the Legislative Decree (LD) 30 June 2003 n. 196 we inform you that our Company Lanarad d. Josef Staffler is responsible for processing the personal data of the customers and suppliers who voluntarily transmit their data to our sales office or management (by telephone, fax or by e-mail). Also included are those persons whose data is collected by third parties, for example in the collection of external data used for sending advertising, in the formation of public lists etc, noting that in the latter case the personal data is generic only.

Our Company guarantees, as meant by Law, that personal data processing will occur with full respect for fundamental rights and freedoms as also for the dignity of those concerned, in particular as regards confidentiality, personal identity and the right to privacy.

Purpose of data processing:

• performance of legal obligations, of obligations deriving from regulations, community directives and from civil and fiscal law
• performance of any contractual obligations towards those involved
• performance of any activity connected with our Company’s trading activity or for production of in-house statistics, invoicing and Company accounting as regards customers and suppliers
• purposes of commercial nature such as sending commercial information and advertising (by post, fax and e-mail), running marketing campaigns and market research
• protection of credits and management of debt
• purposes relative to insurance contracts, above all credit insurance.

In relation to the above listed purposes, personal data, in the case of necessity, may be communicated to the following subjects:

• public administrations and authorities, where foreseen under Law
• banks with which the Company has a commercial relationship for management of credit/debt and for financial intermediation
• all physical and/or juridical persons and public and/or private subjects (legal, fiscal and accounting consultants, tribunals, chambers of commerce etc) when the communication appears necessary or functional to carrying out our activity and to fulfil the purposes described above.

The sensitive data processed by our Company will not be distributed in any way.

Data processing can occur with or without the use of computers and includes all the operations needed for processing sensitive data foreseen by art. 4, comma 1, letter a of the LD 30 June 2003 n. 196. In any case data processing will occur observing all cautionary measures as needed to guarantee safety and confidentiality.

Article 7 of the Law on personal data protection confers on the subject involved the faculty to exercise specific rights, among which that of obtaining, from those responsible for processing, confirmation of the existence or not of the personal data, even if not yet registered. The subject has a right to be informed of the data itself in intelligible form, the origin of the data, the purpose of the processing and the identity of the responsible for processing and of the subjects and categories of persons to whom the data can be communicated; the subject also has the right to obtain confirmation of his data and to require control, correction, integration,  cancellation, block and transformation to anonymous form of the data, if the processing has occurred in violation of Law; the subject can oppose in whole or in part, for legitimate motives, processing of his data and can require cancellation, block and transformation to anonymous form of the data without just cause, if the purpose of the data is for sending commercial information or advertising, for direct sales or for market research or opinion polls.

The rights mentioned can be exercised by the subject, including by proxy, with a request sent to the responsible for data processing by registered mail or by e-mail to the address info@josefstaffler.com.
